1. About these Terms
These Terms & Conditions apply to services booked with Colour Identity Studio, operated by Nicoleta Butuc in Luxembourg.
By booking a service with Colour Identity Studio, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions limits or excludes any mandatory rights available to consumers under applicable Luxembourg or European Union law.

2. Services
Colour Identity Studio provides personal Colour Analysis services and related services as described on the website and booking platform.
Depending on the service selected, your appointment may include:
an in-person personal Colour Analysis;
professional colour draping;
assessment of your individual colour characteristics;
personalised colour recommendations;
a physical personal colour strip;
a bespoke digital Colour Analysis Magazine.
The content, duration and price of each service are those displayed on the website or booking page at the time the appointment is booked.
3. Nature of Colour Analysis
Colour Analysis is an aesthetic and personal-image service based on professional visual assessment and the methodology used by Colour Identity Studio.
The analysis considers how different colour characteristics interact with your natural colouring and results in a professional assessment of the palette considered most harmonious for you.
Colour Analysis involves an element of professional judgement. Recommendations represent the assessment made during your individual session.
Colour Analysis is not medical, dermatological or healthcare advice and should not be interpreted as such.
4. Eligibility
Colour Analysis is recommended from the age of 16.
Anyone under the age of 18 must have permission from a parent or legal guardian to attend a session.
5. Booking an appointment
Appointments are subject to availability.
A booking is considered confirmed when you receive confirmation from Colour Identity Studio or through its booking platform, Acuity Scheduling.
You are responsible for providing accurate and complete information when making your booking.
If any information relevant to your appointment changes, please contact Colour Identity Studio before your session where appropriate.
6. Prices
All prices are displayed in euros.
The price applicable to your appointment is the price displayed at the time the booking is made.
Where a promotional or launch price is offered, the conditions and applicable booking period will be clearly stated with the offer.
Any mandatory taxes will be handled in accordance with applicable Luxembourg law.
7. Payment
No payment or deposit is currently required when booking a Colour Analysis appointment.
After your Colour Analysis session has been completed, Colour Identity Studio will issue an invoice for the service provided.
Payment can be made by:
bank transfer using the details provided on the invoice; or
QR code where a QR payment option is included with the invoice.
Payment should be made within the payment period stated on the invoice.
If you have a valid gift certificate covering the booked service, the applicable certificate will be redeemed against the service instead.
8. Preparing for your appointment
For the clearest assessment of your natural colouring, please:
arrive without makeup;
avoid fake tan before the appointment;
do not wear coloured contact lenses;
avoid perfume and strongly fragranced products;
remove your glasses during the analysis where possible.
If you need to keep your glasses on, the session can be adapted accordingly.
If your hair is dyed, highlighted or otherwise colour-treated, it may be covered during the analysis to prevent the artificial hair colour from influencing the assessment.
There is no need to change your hair colour or wait for it to grow out before your appointment.
9. Arrival and parking
Parking is available.
Please allow sufficient time for your journey, parking and arrival so that you can settle in comfortably and the session can begin at the scheduled time.
If you arrive late, Colour Identity Studio will make reasonable efforts to complete your session. However, the appointment may need to be shortened where extending it would affect another client.
If there is not enough time remaining to carry out the Colour Analysis appropriately, the appointment may need to be rescheduled.
10. Cancellation and rescheduling
If you need to cancel or reschedule your appointment, please provide at least 48 hours' notice.
Appointments cancelled or rescheduled with at least 48 hours' notice can be changed without charge.
If you need to cancel or reschedule less than 48 hours before your appointment, please contact Colour Identity Studio as soon as possible.
At present, Colour Identity Studio does not charge a cancellation or no-show fee, as payment for regular Colour Analysis appointments is only requested after the service has been provided.
Repeated missed appointments or repeated short-notice cancellations may affect the ability to accept future bookings.

11. Cancellation by Colour Identity Studio
In the unusual event that Colour Identity Studio needs to cancel or reschedule your appointment because of illness, emergency or another circumstance preventing the session from taking place, you will be contacted as soon as reasonably possible.
A suitable alternative appointment will be offered.
You will not be invoiced for a service that has not been provided.
12. Online bookings and the statutory right of withdrawal
When you book a service online, the booking may constitute a distance contract under consumer law.
For service contracts concluded at a distance, consumers generally have 14 calendar days from the date the contract is concluded to withdraw without giving a reason. Guichet.public.lu
If your appointment takes place before that 14-day period has expired, you may be asked during booking to expressly request that Colour Identity Studio provide the service on the appointment date you selected.
If the service has been fully performed during the withdrawal period after the required request and acknowledgement have been provided, the statutory right of withdrawal may cease in accordance with applicable consumer law.
If you withdraw after requesting that performance begin during the withdrawal period but before the service has been fully performed, applicable law may require payment for the part of the service already provided.
Your statutory right of withdrawal is separate from Colour Identity Studio's 48-hour Cancellation & Rescheduling Policy.

13. How to exercise a statutory right of withdrawal
Where a statutory right of withdrawal applies, you may exercise it by sending a clear statement that you wish to withdraw from the contract.

Your communication should clearly identify the booking concerned.
You may use the model withdrawal form at the end of these Terms, but use of the form is not mandatory.
14. Your physical colour strip
Where included in your booked service, you will receive a physical personal colour strip representing colours from your identified palette.
The strip is intended as a practical reference to support future colour choices.
Printed and physical colour references may show minor variations depending on material, production, lighting and surrounding colours.
15. Your Colour Analysis Magazine
Where included in your service, you will receive a bespoke digital Colour Analysis Magazine prepared following your individual appointment.
The Magazine may include:
your individual Colour Analysis result;
an explanation of how your season was identified;
recommended colours and neutrals;
colour combinations;
WOW colours;
colours to approach with caution or avoid;
jewellery and metal recommendations;
makeup guidance;
hair colour guidance;
prints and patterns;
eyewear guidance;
an extended seasonal colour gallery.
Because the Magazine is personalised, its contents may differ between clients even where clients share the same seasonal palette.
The Magazine may be delivered after the appointment once preparation has been completed.
16. Personal use and intellectual property
Your Colour Analysis Magazine, colour strip and personalised recommendations are provided for your personal use.
You are welcome to save, access and use your own materials as a personal reference.
The design, written content, layouts, graphics, educational materials and other original content created by Colour Identity Studio remain protected by applicable intellectual-property rights.
Colour Identity Studio materials may not be:
commercially reproduced;
resold;
republished as another person's work;
distributed as professional training material;
copied to create competing commercial products or services;
without prior written permission from Colour Identity Studio.
17. Gift certificates
Colour Identity Studio gift certificates are valid for one year from the date of issue.
The expiry date will be stated on the gift certificate or associated purchase information.
Gift certificates must be redeemed before their expiry date.
A gift certificate purchased for a specific Colour Identity Studio service may be used for the service identified on the certificate, subject to availability.
Gift certificates:
may be given to another person as a gift;
should be kept securely until redeemed;
may be used once unless otherwise stated;
cannot normally be exchanged for cash, except where required by applicable law;
remain subject to mandatory consumer rights.
If a gift certificate represents a monetary value rather than a named service, its value will be applied against an eligible service when redeemed.
If the price of a service changes after a gift certificate has been purchased, the conditions stated on the certificate and at the time of purchase will apply.
18. Gift certificate appointments
The recipient of a gift certificate must still book an available appointment through the applicable booking process.
The normal preparation, cancellation, rescheduling and arrival conditions apply to appointments booked using a gift certificate.
Expiry of the gift certificate relates to its redemption in accordance with the conditions stated when it was purchased.
19. Third-party services
Colour Identity Studio uses third-party services to support certain aspects of its business.
These may include:
Squarespace for the website;
Acuity Scheduling for appointment booking;
Heyzine for digital publication functionality;
email and technical service providers;
mapping and other external services.
Colour Identity Studio is not responsible for temporary interruptions or technical failures of independent third-party services that are outside its reasonable control.
Reasonable efforts will be made to minimise any resulting disruption to clients.

20. Photography and promotional use
Photographs or other identifiable client content will not be used for promotional or social-media purposes solely because you booked a Colour Analysis session.
Where identifiable photographs or content are intended to be used for marketing or promotional purposes, appropriate permission or consent will be obtained separately where required.
Agreeing to promotional use is not a condition of receiving a Colour Analysis service.
21. Website information
Colour Identity Studio makes reasonable efforts to ensure that descriptions of services, prices, availability and other information on the website are accurate.
Minor errors or temporary technical issues may occasionally occur.
If an obvious error affects a booking, Colour Identity Studio will contact you and seek an appropriate resolution.
22. Liability
Colour Identity Studio will provide its services with reasonable care and professional attention.
Nothing in these Terms excludes or limits liability where liability cannot legally be excluded or limited.
Colour Identity Studio is not responsible for losses resulting solely from circumstances outside its reasonable control, subject always to mandatory consumer rights.
Individual preferences and responses to colour are personal. The professional recommendations provided during Colour Analysis do not guarantee that every client will personally prefer every colour included within a recommended seasonal palette.
23. Complaints
If you have a concern about a service, please contact Colour Identity Studio first:
Colour Identity Studio will make reasonable efforts to review and resolve the matter directly.
Where a consumer dispute cannot be resolved directly, eligible disputes may be referred to Luxembourg's Service national du Médiateur de la consommation, which provides an out-of-court dispute-resolution procedure. 24. Applicable law
These Terms & Conditions are governed by the laws of the Grand Duchy of Luxembourg.
Where you are a consumer entitled to mandatory protections under another applicable jurisdiction, nothing in these Terms removes rights that cannot legally be excluded.
25. Changes to these Terms
Colour Identity Studio may update these Terms & Conditions where services, business practices or legal requirements change.
The version applicable to a booking is generally the version in effect when that booking is made.
Changes will not retrospectively remove rights already acquired under a confirmed booking.
